The Jackson Middle School controversial Jesus portrait has been moved, but not too far.

Jackson City Schools Superintendent Phil Howard confirmed Wednesday that the picture has been moved to the Jackson High School.

The Hi-Y Club, owners of the portrait and religious-based high school club, are currently in a legal battle over having the picture removed.

The American Civil Liberties Union of Ohio and the Madison, Wis.-based Freedom From Religion Foundation say the large portrait unconstitutionally promotes religion.

They filed a lawsuit in U.S. district court on behalf on an unidentified student and two parents in February.

Howard says the lawsuit has not been dropped.
