Court Gives Police More Time For Tracking Devices

The Ohio Supreme Court is giving police more time to install an electronic tracking device after they get a search warrant.

The rule change by the court Monday gives law enforcement up to 10 days – instead of the current three days – to secretly install a tracking device. The court says the device can stay in place for 45 days.

The rule also requires that suspects whose vehicles are tracked must be given a copy of the search warrant within 10 days after the device is removed, unless police can show why a longer delay is needed.

Prosecutors had argued that it sometimes takes more than three days to safely and secretly install a tracking device.

The rule change takes effect July 1.
